These Terms & Conditions ("Terms") govern your use of the website gajhomesbuying.com and the services offered under the brand Gajhomes, operated by SPS Realty & Services ("Gajhomes", "we", "us" or "our"). By creating an account or using this website, you agree to these Terms. If you do not agree, please do not use the website.

1. About Gajhomes

Gajhomes is a real-estate group-buying platform. We list verified residential projects and bring together buyers who are interested in the same project, so that we can negotiate with the developer as a group and try to obtain better prices and offers for the group members.

SPS Realty & Services is registered as a real estate agent with the Maharashtra Real Estate Regulatory Authority (MahaRERA) under Registration No. A031262501442.

Gajhomes is not a developer or builder. We do not own, construct or sell the listed properties. Every purchase is a direct contract between you and the developer.

2. Eligibility and Account

• You must be at least 18 years old and legally able to enter into a contract to use our services.
• You sign up and log in using a one-time password (OTP) sent to your email address. You are responsible for keeping access to your email account secure.
• The details you provide (name, email, mobile number, preferences) must be true and up to date.
• One person may hold only one account.

3. Free and Premium Membership

• A Free account lets you browse listed properties and their details.
• A Premium Membership unlocks group-buying features, including joining buyer groups, requesting to connect with other buyers through the Gajhomes team, group site visits and negotiation support.
• The Premium Membership fee is ₹499 and the membership is valid for 1 (one) year from the date it is activated.
• Payment is made by scanning the QR code shown on the website and uploading the payment screenshot. Your membership is activated only after our team manually verifies the payment. Activation is not instant.
• We may reject a payment submission if the screenshot is unclear, incorrect, duplicated or cannot be matched with a payment we received.
• Refunds of the Premium fee are governed by our Refund & Cashback Policy.

4. How Group Buying Works

• A Premium member can join the buyer group of up to 3 (three) properties at the same time.
• Joining a group shows your interest in a project. It is not a booking and does not reserve any unit for you.
• Other group members see only a masked version of your name (for example, "Rahul S.**") along with your buying intent and timeline. Your phone number and email are never shown to other members.
• If you want to connect with another member, you can send a "Request to Connect". The Gajhomes team will contact both buyers and connect you only with the consent of the other buyer.
• Discounts and offers depend on the developer and on the number and seriousness of buyers in a group. We do not guarantee any specific discount, price, unit, or that a group deal will happen.

5. Broker Commission Cashback

Where Gajhomes earns a brokerage from the developer on your purchase, we may pass a part of it back to you as cashback (shown on the website as "₹50K to ₹5 Lac Broker Commission Cashback*"). The cashback amount, eligibility and timing are governed by our Refund & Cashback Policy. The amounts shown on the website are indicative ranges, not a promise of a fixed amount.

6. Property Information

• Property details, prices, floor plans, brochures, images, possession dates and RERA details are provided by developers or taken from public sources. We try to keep them accurate, but they may change without notice.
• Images may be artistic impressions. Prices are indicative and may not include taxes, stamp duty, registration and other charges.
• Before making any payment to a developer, please verify all details yourself, including the project's RERA registration on the MahaRERA website, and read the agreement carefully.

7. Your Responsibilities

While using the website, you agree that you will not:

• provide false information or impersonate another person;
• try to obtain the contact details of other buyers outside the process described above, or misuse any information you receive about other buyers;
• contact developers listed on Gajhomes directly to avoid the group deal after joining a group through us, in a way that harms the group;
• upload fake or edited payment screenshots;
• copy, scrape or misuse website content, or try to disrupt, hack or overload the website.

We may suspend or delete your account if you break these Terms. If a Premium account is suspended because of misuse, the Premium fee will not be refunded.

8. Intellectual Property

The Gajhomes name, logo, website design, text and content belong to SPS Realty & Services, except developer content, which belongs to the respective developers. You may not reuse them without our written permission.

9. Limitation of Liability

• Gajhomes acts as a facilitator and real estate agent. We are not responsible for construction quality, delays in possession, changes in project plans, or any other obligation of the developer.
• We are not responsible for any decision you make based on information on the website. Please take independent legal and financial advice before buying property.
• To the maximum extent permitted by law, our total liability to you for any claim related to our services is limited to the Premium fee you paid to us.

How we collect and use your personal data is explained in our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. If you continue to use the website after the changes, you accept the updated Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute will first be attempted to be resolved through discussion with us. If it cannot be resolved, it will be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.
